NJ Recreational Cannabis Laws 2026

New Jersey legalized recreational cannabis for adults 21 and older in April 2022. Here is where things stand in 2026; what you can buy, where you can consume it, and what still carries a penalty.


Who Can Buy

Any adult 21 or older with a valid government-issued photo ID. New Jersey residency is not required. Out-of-state visitors, including Pennsylvania residents, are welcome at any licensed adult-use dispensary.

A valid ID means a driver's license, state ID, or passport. Expired IDs are not accepted.


How Much You Can Buy and Possess

Adults can purchase and possess up to six ounces of cannabis flower at one time in New Jersey.

Individual dispensary purchase limits per transaction are set at one ounce of flower or 1,000 milligrams of cannabis-infused products. You can visit multiple dispensaries in a day, there is no statewide tracking of purchases across locations.

Possession of more than six ounces is a disorderly persons offense. Possession of more than one pound is a felony.


Where You Can Consume

This is where most people get tripped up.

You can consume cannabis on private property with the property owner's permission. That generally means in a home, yours or someone else's if they allow it.

You cannot consume cannabis in a vehicle, whether it is moving or parked. This includes Ubers, rideshares, and any other hired transportation.

You cannot consume in public spaces; sidewalks, parks, beaches, parking lots, or anywhere visible from a public road. New Jersey has not established licensed consumption lounges at scale, so public consumption remains off limits for most practical purposes.

Hotel and rental property rules vary. Some explicitly prohibit cannabis consumption on their premises. Check before you assume.


Driving and Cannabis

Do not drive under the influence of cannabis. New Jersey law prohibits driving while impaired by any substance including cannabis. Law enforcement can conduct sobriety tests and impairment is assessed behaviorally, not through a specific THC blood level threshold.

If you are transporting cannabis in a vehicle it must be in a sealed, closed container, not in the passenger area where it can be accessed while driving. The trunk is the safest option.

And as covered elsewhere on this site, cannabis cannot cross state lines. Do not drive back into Pennsylvania with cannabis in the car regardless of how much or how little it is.


Cannabis and Employment

New Jersey law prohibits employers from taking adverse action against employees solely for off-duty cannabis use. However, employers can still enforce drug-free workplace policies and prohibit use during work hours. Employees in safety-sensitive positions, transportation, law enforcement, and others, may face different rules.

If your job involves drug testing, know your employer's specific policy before assuming the law fully protects you.


Medical vs. Recreational

Medical cannabis patients in New Jersey are exempt from the state sales tax that applies to recreational purchases. Recreational buyers pay a 6.625% state sales tax plus a local municipal tax, typically 2%, for a total of around 8.6%.
